[Police Detective William Mayo Coerced Miguel A. Ballard Jr Into Consenting Car Search]
Traffic stop of Miguel A. Ballard Jr., on June 27, 2018, at 16th and Burwell by the Ninth Mobile Division, for improperly wearing a seatbelt.
Ballard denied consent to search the van, then changed his mind. Police found a gun inside and charged him with possession of a handgun by a convicted felon, violating a protective order, carrying a concealed weapon and failing to wear a seatbelt.
But a judge later suppressed the gun evidence, ruling the stop was impermissibly extended and that consent to search was coerced. Ballard is now charged solely with the seatbelt violation.

You know why we stopped you, right? What did you just do with the seatbelt? You had your seatbelt behind the door and you just flipped it back over. It’s on camera.
That’s why you stopped me?
[Police:] Source: LYBIO.net
You don’t have your seatbelt on improperly. You don’t have your seatbelt on improperly. Getting a little – getting a little stench of marijuana coming in this car and weed…
I have not smoked, sir. I don’t smoke.
[Police:] Source: LYBIO.net
You got anything that’s going to get you in trouble?
No, I didn’t do that, sir.
[Police:] Source: LYBIO.net
No, no, I didn’t ask you that. Do you have anything that’s going to you…
No, sir.
[Police:]
Okay. You seem very, very nervous, agitated.
Sir, I didn’t do nothing.
[Police:]
Well, you didn’t do anything serious, but the reason we pulled you over because your seatbelt was on improperly. Yeah, I mean, I’m being honest with you…
The reason why – I will feel nervous because you’re the police.
[Police:]
Yeah, but I’ve never hurt anyone in my whole life. I’ve never shot anyone. Never hurt anyone. So, I’m a big teddy bear. Why don’t you hop out of the car for me?
I got to hop out?
[Police:] Source: LYBIO.net
No, I’m asking you to hop – yes, sir. Do you have any – anything that’s going to get you in trouble? Can you open the pockets for me? You’re good. I’m just going to make sure you have no guns. Come here within car parking for me?
Here? Right here. Right here. Right here.
[Police:] Source: LYBIO.net
I don’t care what you have in that car. I truly, honestly don’t. I don’t care if you got…
I don’t have nothing.
[Police:]
Then that’s fine. Let me just give you my spiel. I don’t care if you have weed, I don’t care if you heroin, I don’t care if you have meth, I don’t care if you have a dead body back there. We’re not homicide, we’re not narcotics, I’ll never want to work any of those units. All we do is we’re just gun cops, period. All we care about is guns. So you can be out of here in 120 seconds. I just make sure there’s no guns in that car, you’d be in the car, you gone. If there’s weed in that car, it’s going to end up on the pavement, under my boot or under your shoe and you’ll be on your way. You’re not narcotics. Again, chasing dope is stupid.
I just don’t see why I got pulled over?

I’m going to say this last thing. There’s two types of people that don’t give us all 45 seconds; people who are just assholes, which you don’t seem like an asshole, you seem cool or people who’ve got something hot. So, again, make sure you clear that car for guns, give your ID back, you’ll be on your way, all right? Are you cool?
Yes, sir.

Alright, have a seat right here for me. There’s something – there’s going to be something in here, just by the way he’s acting.
Yeah.
[Police:]
If I was a gun, where would I be?
I think it might be…
[Police:]
I think there’s something else in here than just that crate.
I don’t know that he would’ve – see he is digging, he probably wasn’t digging in his backpack.
[Police:]
He was digging. He was looking all over this car.
Bags.
[Police:] Source: LYBIO.net
There’s got to be a gun in here somewhere.
Am I going to jail?
[Police:] Source: LYBIO.net
You were found – probably right now, yeah.
