And while we are there, let me add, I think Bombay High Court and all the, all of judiciary for that matter seems to be stuck in the middle ages. They seem to be under the impression that people have to be seized with mortal fear when faced with a judge’s order.

Guys this is the 21st century. This is the age of social media. This is the age of connectedness. This is the age when the meaning of publication has changed, is changing rapidly, but the Bombay High Court and all courts, all of Indian Judiciary refuses, actively refuses and resists the move to have video recording and audio recording of the proceedings.
And today’s case was exactly an illustration of an instance why the judiciary needs recording to happen. It needs recording to happen, to keep proceedings clean and to keep judges clean.

I am going to say a lot of things and I would love them, I would just love them to quote each and every word of what I say, transcribe each and every word of what I say and try me for contempt for each and every word.
I’m willing to go to jail for my beliefs, I will not yield.
Coming to what happened in court today.
Ham logo ke laude lag gaye. What happened is from their side, Janak Dwarkadas, who is known to be as a giant, he’s a senior counsel, I think he is under retainership of Lodha. He appeared on the Lodha’s behalf. Uh… From our side it was a team from Maalveer and Chodji & Company. They are public interest lawyers and they’re nice people and they have drafted our case well.
I’m very happy with their drafting. I’m very happy with the way they wanted to, wanted things to go.

I’m a bit less than happy with the way things went and I’m going to share that with you.
What happened basically is in a nutshell, our proceeding ran for about 18 minutes. I’m told it was around 18 minutes of-which for 17 minutes, Mr. Janak Dwarkadas senior counsel, just kept on hammering one narrative, one narrative based on hearsay. He did not read a line of what I had said. He basically just created a narrative of me and Shilpi being blackmailers and extortionists and having made this viral video for – for the purpose of blackmailing Lodha and forcing him to pay Shilpi.
I am supposed to be Shilpi’s paid agent. Okay. He just made up this narrative and the amazing thing is the Judge, went with this narrative from the first moment. He was sympathetic, Justice Sriram. He was openly, openly sympathetic to Lodha’s side to Janak Dwarkadas. Venerable old gentleman and the venerable old gentleman was allowed to weave this perverse narrative where Lodha is a victim and we are the victimizers.

It was amazing, absolutely amazing that my counsel appearing from – from our side was not even [appeared] not allowed to speak.
I was just so furious. I was just so furious. It is amazing that this venerable old gentleman was allowed to speak for 17 minutes out of the 18. And whenever our chap tried to get a word in edgewise, the judge stopped him.
My counsel tried to have this thing expunged from the records that you are a blackmailers and extortionists because they have alleged in their, in their plaint that we are blackmailers, extortionists that kind of thing, slanderous without a shred of evidence. And my counsel tried and failed because the judge was not willing to listen. He made light of the whole thing. He seemed to think that it was perfectly legitimate to go with the narrative, to go with the story that I am a blackmailer, an extortionist standing behind – behind Shilpi a hired gun for money.
Okay. Then let us go further with that narrative. Shilpi has paid me till date, something like 35,000, 40,000 bucks is that enough to compensate a man for going to prison?
If necessary, I will go to prison for my beliefs.
I am not going to be silenced.
It was a perverse proceeding and the whole thing, the whole objective of this venerable old gentleman was that the law of the land – on defamation be turned on its head and the articles, the blogs, the material that I’ve put out there, the evidence of Lodha’s blatant violations of safety should be all deleted based on this one narrative that I am a blackmailer, I am an irresponsible citizen, I am not a journalist. I’m a nobody. I’m a nothing.

He – some tapori I-m a rat. I’m a gutter rat. It is that kind of a narrative. The judge treated me with complete contempt and then he goes on to say that let the defendant number two, that is Shilpi and her husband number defendant number three, let their flat be inspected, let Lodha repair their flat, let their dispute between them be resolved.
The venerable old gentleman was at pains to avoid the involvement of the entire Lodha New Cuffe Parade or for that matter, the – the larger issues relating to Lodha’s dealings.
He was at pains to suppress the whole thing and he was at pains to say, uh yes, architects should be appointed but only to look at Shilpi’s flat and maybe one flat above or below. That too flats chosen by their side.

It was amazing to see the judge restrict the scope of the, the court appointed architect. Okay. And they are going to appoint an architect, a court commissioner, I think they call them to go and investigate whether there is truth and the only truth he wants to look at, he doesn’t want to look at the basements. He doesn’t want to look at the chimney like structures. He doesn’t want to look at the fire hazards. He only wants to look at the insides of Shilpi’s house – basically.
And if they find lacuna, then the solution that the good judge seems to think viable or necessary is that Lodha will fix Shilpi’s flat.
Say, hey listen, you have these grievances, we fixed it. Now fuck off.
And Shilpi will fall silent and then the intention is that armed with this tiny little report only about Shilpi’s flat the report presumably will give the judge enough reason to say that what I have said, what I have written, what I have made videos about is false. That gypsum board, the way they have used it is okay.
He will call it, defamation, he will say that there is no truth in my allegations and he will ask me to delete the whole thing.
He will pass an order and if I don’t delete it, of course I’ll be held in contempt.

Well judge, let us change things around a bit.
This is your game. This is the way you have held this proceeding, there was no due process. There was no reference to what defamation is and isn’t. My counsel wasn’t heard. The points that he was making weren’t even heard, he was cowed down, he was intimidated, he was bamboozled. There was no due process. I have not been heard. Your order we’ll see what we’ll do with that order.

As for you judge it was un-judicial behavior. It was unbecoming behavior for a judge, for a High Court judge.
My faith in judiciary is shaken down to the roots and I’m going to say this out loud. If this is contempt, I’m in contempt. Hold me in contempt because chief, you did not do the judiciary any favors today.
I will not fall silent.
This blackmailer, this extortionist, this rat from the gutters, this nobody will not fall silent as for Lodha I will not fall silent either.
So, that will be two counts of contempt won’t it be?
Let’s see how many counts of contempt. Try me for contempt.

The judiciary needs to wake up to this, to this malpractice, to this corruption based on face value of senior counsels, to this corruption based on arbitrariness of judges who refuse to be held accountable, who refuse to follow due process, who think that they can bamboozle lawyers and bamboozle the parties and not give them the service that the judges are being paid for.
The judges are paid to behave like judges. If they behave like thugs of builders, they will be treated like thugs of builders and I will not yield – and people like me will not yield.
Now the fight has gone beyond Lodha.
Judicial proceedings must be video-graphed. Must be audio recorded. And the audio recordings or audio-video recordings should be given to the parties immediately, and it should be placed in public domain. It should be uploaded to the Internet.

This fight is now not about Lodha. It is about a clean judiciary.
In the course of this, this, this kangaroo court, this funny proceeding – they, the other side mentioned that I had pornographic content on my – alleged that I had pornography content on my blog.
