Animal Care Sanctuary is celebrating our 50 anniversary. We care for over 500 animals every day. Chesapeake approached us in 2009 and 2010 to sign a lease with them.
[Lois Neuber (Wilmot Township):]
I had him come into our dining room, which is connected with our kitchen and sat at the table. I even offered him refreshments.
[Jim Barrett (Barrett Farm):]
We were visited by several Landman who showed an interest in buying the right to look for gas and such on our property. My brother and my cousin we sat at our kitchen table listened after maybe a week or two of meetings we signed the lease and thought we were doing pretty good.
[Dale Grover (Chesapeake Landman):]
0% of the time was right at the kitchen table. The man and the woman sat right there and that was their office right at the kitchen table.
[Wayne Felter (Wyalusing Township):]
He said you get 12.5% that’s the state law.
Mr. Smith pointed out that we were lucky that we lived in the State of Pennsylvania because we had a guaranteed minimum royalty act.
The representatives from Chesapeake that I worked for, that was a big selling point 12.5% was guaranteed by the State.
And in 2012 we received a letter from Chesapeake Energy stating that based on the Kilmer Elexco Land Service LLC ruling by the Pennsylvania courts that Chesapeake was going to the right thing and start taking deductions.
You never know because last year in 2015 there were ten months, I got zero.
Chesapeake decided that they wouldn’t send us any revenue for 18 months while they continue to draw gas from the ground.
The worst cheque that I got was one where they sent me a bill for $629 for taking my gas, I didn’t get anything they charged me $629.
All of a sudden our payments were gone but then to receive a letter saying that we owed them $30,000 was pretty, we were irate.
And then, when it started going south things changed a lot around here.
As my husband went through the brain tumor and the treatments and everything before he passed away told me, he said I don’t know whether I exactly trust them like I thought I would.
I don’t have very much income with a little you know social security because it is all I got.
You know our operations are to care for the animals and the people that take care of them and we – we don’t have excess funds that we can just write Chesapeake a check back.

But I don’t think that the Supreme Court felt that Chesapeake would go to the ends they have to rob the checks.
All small landowners who were seeing their deductions taken, they don’t have the ability to hire a lawyer and certainly hope that the legislators would rectify the problem. I mean they wrote the law, if they left a little grey area all they have to do is clean it up and the Pennsylvania courts have asked them to clean it up.
Trying to be moral about this, we look at that – that way and they are looking at donations. It’s tough for us to fight against that.
If they’re receiving these donations. They’re certainly going to be swayed I don’t know how many thousands or whatever they – the gas companies give them.
Not everybody is bad as Chesapeake, there’s a lot of good people here Talisman, Repsol, Southwest that follows the leases as they were written, follows the latent of the law, treats their people fairly.
Chesapeake guys tell how he’s lying because his mouth’s moving.
Oh I definitely felt I misled people. It was just, you know, I did it in good faith, I thought for sure it was great for the economy and everything in this area and then this happened.
Being up here in the mountains sometimes we’re forgotten a little bit by the people we put in office in the Harrisburg, the people who can’t take anymore, they’re stealing from these people, and people are getting very upset. There’s going to be trouble. There’s going to be trouble and I.
