Your Honor, I don’t have any representation I don’t believe that this is a political matter. This is an issue about criminal justice I believe the court room is the proper place to make issues about criminal justice.

I – this is not political speech, it’s not supporting a particular candidate and its not political speech I don’t believe that the DAs have been made to take off DA buttons, I don’t believe that Marshalls have been made to stop wearing the black bands when its something there has been a death.

[Judge Robert Milich:]
Wear it in the hallways, wear it in front of the court house it demonstrate protest, use your voice. But that’s not what’s supposed to occur in a court room. When we’re not here or a petition about a movement or a protest or anything like that, we are here to dispense justice on a criminal counter of cases and that’s why I think it’s inappropriate. And if other judges think its okay to have that in the court rooms I respect that, that’s their decision to make. But as I said, I think, you know what, that’s not the purpose of coming to court, and I think Erika will admit, when we are talking this morning in the Chamber she was saying like I think it is appropriate here but this is where there is disparate treatment of African-Americans in hardship penalties on African-Americans I mean that’s its making it a political statement that I wear this in protest in how the court is treating minority defendants. And that’s not what this is about.

[Erika Ballou:]
I would ask for my cases to be reassigned from you because I’m not comfortable giving my case to someone else to handle and I’m also not comfortable abridging my free speech…

[Judge Robert Milich:]
I’m not going to refuse off my cases under the judicial guidance I’ve got an obligation to hear my cases, I don’t have any conflict with you, I’m just asking you the same thing as I’ve asked somebody that’s inappropriate to wear a court, you got to put something else on, those clothing items are inappropriate or you can’t wear your hat in court I mean this is no different than those types of things.

I’m just asking you to court forum to the courtroom decorum, it is not a conflict with you or your clients or anything so well I’m not going to refuse off cases and I’m obligated to hear that’s been assigned. If you don’t have an opportunity I’ll pass the case with something if you guys want to chat about it or pass it to another day if you want to chat about it in the court room further.

He continued the matter until Thursday because I’m in trial next week. And what I’m going to do in the mean time is try and see what the case law says I wasn’t prepared for a first amendment fight this morning. I was just coming over to do my sentencing, do my job. He told me that I had to take it off or have someone else handle the matter. I told him I wasn’t going to take it off, the judges entitled to handle his court room anyway he wants to and if he doesn’t want me inside then I’m not going to be inside.

I’m trying to be respectful but I’m also trying to get my point across that Black lives matter, this is not anti-police, Black lives matter is anti-police brutality. And if the problem with is the black and Black lives matter I need to understand why.
